It is also the single most mythologized Georgian document, from "live half a year and you are free" to "you can get it without ever visiting". The truth is more specific: there are two routes, each with its own thresholds, and both have limits that rarely get written down honestly.

There are two routes to Georgian tax residency. The first: 183 days of physical presence within any 12 consecutive months; the status arises automatically and the Revenue Service issues the certificate. The second: High Net Worth Individual (HNWI) status, with no residence requirement, based on wealth over 3,000,000 GEL or income over 200,000 GEL per year in each of the last three years, plus one Georgian condition: local income of 25,000+ GEL per year or a Georgian residence permit. The certificate is issued for a specific tax year and is renewed annually. Important: the certificate confirms your Georgian status but does not automatically cancel residency of your home country; that is resolved through double-taxation treaties.

183 days is the key threshold

Why the status matters

Three practical reasons. First, the certificate for your home tax authority: the document that says your tax home is now Georgia and triggers the double-taxation treaty. Second, Georgia's personal tax regime: residents are taxed on Georgian-source income, while most foreign personal income (foreign dividends, for example) is generally not taxed for resident individuals, given a correct structure. Third, and unexpected for many: residency opens doors inside Georgia itself: a single-member Virtual Zone company, for one, requires its sole member to be a tax resident.

Route 1: 183 days

The mechanics: spend 183 days or more in Georgia within any 12 consecutive months and the status arises for the relevant tax year. Practical details:

  • The window slides. Not a calendar year but any 12 months in a row: arrive in August, and the August-to-July window works too.
  • Days are counted by actual presence. Passport stamps, boarding passes and flight history are the evidence; the Revenue Service practice is exactly that: passport, day count, Georgian ID number.
  • Some categories of days follow special rules (medical treatment, certain vacation grounds); if your case is unusual, count the days with an advisor before filing rather than after a refusal.
  • Visas are rarely the problem: the visa-free year most passports get covers 183 days with room to spare.

The status arises automatically, but your home tax authority needs a document, so the next step is always the same: the certificate.

Route 2: HNWI, residency without residence

For those not ready to live in Georgia half the year, there is High Net Worth Individual status. The thresholds:

Physical presence of 183 days is not required, and filing through a representative is possible. Per consultants' practice the process takes around 3-4 months including preparation; documenting the wealth and income is the heaviest part of the package. The classic way to satisfy the Georgian condition: a deposit or property generating local income, or a residence permit (including through an IE).

The certificate: how it is obtained

The tax residency certificate comes from the Revenue Service (rs.ge). In practice: an application through the personal cabinet or a service center, a passport, the day count (for the 183 route) or HNWI confirmations, and a Georgian TIN. The detail people miss: the certificate is issued for a specific tax year. It is not a lifetime status; if your life stays split between countries, you renew it annually, proving the grounds each time.

The honest part: what the certificate does not do

In the r/Sakartvelo thread on residency and IEs one commenter puts it bluntly: claiming Georgian residency while actually living elsewhere "will not survive investigation by your country". That is true, and here is how it works:

  • You can be resident in two places at once. The Georgian certificate does not switch off your home country's rules: each country has its own criteria (housing, family, center of vital interests), and you may qualify under both.
  • The resolution runs through the double-taxation treaty: the tie-breaker sequence (permanent home → center of vital interests → habitual abode → citizenship). The fewer ties left at home, the cleaner the picture.
  • Some countries let go reluctantly. A commenter in the same thread warns a Norwegian that shedding Norwegian residency is "especially hard". Several jurisdictions have exit rules; check yours.

Our position is simple: Georgian residency works beautifully when it is real, with actual days, housing and a life here. As a paper construction without relocation it creates risk instead of savings.

How it fits the IE, the 1% and the Virtual Zone

For a relocated Georgian IE holder residency completes the structure: the 1% on turnover is paid in Georgia regardless of status, but residency is what answers "and who taxes the rest of my income". Foreign personal income (dividends, interest) is generally untaxed for resident individuals, with the caveat about correct structuring: the discussions rightly note the requalification risk for artificial schemes. And for IT founders there is a specific technicality: a single-member Virtual Zone company requires its sole member to be a tax resident; without the 183 days, a solo VZ does not assemble.

Three scenarios

A relocated IE holder living in Tbilisi. The 183 days accumulate on their own. In year one: count days from the entry date, keep boarding passes, take the certificate at the end of the window, and hand it to your home tax authority along with whatever exit notifications your country requires.

Split life: 4 months here, 8 there. No Georgian residency by days. Options: rebuild the calendar around 183 days, look at HNWI if the thresholds are yours, or accept honestly that your tax home is still elsewhere.

Capital, but no desire to relocate. HNWI: document the wealth or income, add the Georgian condition (local income of 25,000+ GEL or a residence permit), file through a representative. Renewal is annual.
